This Terms of Use and Privacy Policy was last revised on October 30, 2009.

New Orleans: A Labor of Love created this Site to make it simple for users to share information about their commitment to rebuilding the Gulf Coast with their friends and others with similar interests. We give you control of your information because you may not want to share your information with everyone. You choose what information you provide, including contact and personal information. You control the sharing of that information by using the privacy settings on the Site.

This Statement of Rights and Responsibilities ("Statement") derives from the New Orleans: A Labor of Love Principles, and governs our relationship with users and others who interact with New Orleans: A Labor of Love. By using or accessing www.nolaboroflove.org and associated New Orleans: A Labor of Love social media properties, you agree to this Statement.

 

Your privacy is very important to us. This Privacy Policy is designed to help you understand what information you may provide, how we use and share the information, how we will not use or share information, and your choices when using this Site located at www.nolaboroflove.org (the "Site") and the Petition: It's Been Four Years! Rebuild New Orleans! Application, located at apps.facebook.com/nolaboroflove, (the "Application"). We will not use or share your information with anyone, except as described in this Privacy Policy.

Information You Provide

While using the Site, you may provide us with anonymous information, personal information and additional materials.

You provide us with anonymous information such as your IP address, areas of the Site you have visited, time and date, and whether or not you clicked on links. We use technologies such as cookies to collect this information. A cookie is a piece of data stored on a user's computer. We use session ID cookies to confirm that users are logged in. Session cookies terminate once the user closes the browser. We also use persistent cookies that store other information to make it easier for you to login when you come back to the Site. You can configure your browser to block cookies; however, if you do, the Site may not function properly or at all. If you choose to click on a link to any outside website, anonymous information may be provided to that website.

You may provide us with your personal information if you register at the Site, like your username, password, first and last names, email address, and mailing address. You may provide additional personal information for your profile.

You may also post information, opinions, voting records, text, sounds, photographs, audio, video, images, graphics, and other content or materials of any nature (collectively, "Materials") to the Site. You have control of who sees this Material through your use of the privacy setting available through the Site. If you choose, the Materials will be viewable by other users.

 

Use of the Information We Collect

You are in control of sharing personal information that you provide to the Site by using the privacy settings. If you choose to post Materials directly to public portions of the Site such as New Orleans: A Labor of Love forums, communities, or message boards, obviously those Materials may be available to other users. New Orleans: A Labor of Love may use personal information you elect to provide to us in order to provide products and/or services to you and, if you elect, other users and for administration, maintenance and development of the Site.

Your personally identifiable information will not be sold to advertisers or spammers.

If you provide your email address at the Site, we may use your email address to contact you and notify you of any Site news. Generally, you cannot opt-out of receiving certain communications such as service-related announcements and administrative messages, except by terminating your account.

New Orleans: A Labor of Love may use anonymous information collected to improve the quality of the Site. This information may help us to diagnose problems, maintain security, and provide services users want. New Orleans: A Labor of Love may determine user demographics, interests, and behavior and may share such anonymous information with others. For example, we may provide demographic or usage information to an organization so they may see how many users are from a specific geographic area or industry.

 

Spreading the Word

In order to spread the word and promote New Orleans: A Labor of Love you may elect to opt-in and take advantage of one of our optional promotion services. If you choose to opt-in, we will use the email addresses in your address book to send a one-time email to those email addresses with information about the Site. If you prefer, you may opt to provide a friend's email address, and we will send that friend a one-time email inviting the friend to visit the Site. We may use the email information to track the success of these email services. Anyone we send an email to through one of these features may contact us at privacy-AT-nolaboroflove.org to request that we remove their information from our database.

 

Sharing of Information

We share your personally identifiable information in three cases: (1) with your permission, (2) as required by law, and (3) change of ownership, each as more fully described in the paragraphs below.

You may opt-in to allow third parties, such as nonprofits, to receive the information you provide by checking the appropriate box when you are providing information. If you tell us to share your information with a third party, the third party's use of that information will be governed by their privacy policy, not ours.

We may be required to disclose user information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. We do not reveal information until we have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. Additionally, we may share account or other information when we believe it is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity perpetrated through the New Orleans: A Labor of Love service or using the New Orleans: A Labor of Love name, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents or government agencies.

If the leadership of all or substantially all of New Orleans: A Labor of Love's organization, or substantial portions of the business owned by New Orleans: A Labor of Love, were to change, your information may be transferred to the new leadership so the new leader(s) can continue providing services to you. In any such case, your information would remain subject to the protections provided in our Privacy Policy.

You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. Please remember that anyone who has access to your username and password may be able to access your personal information; therefore, we encourage you to keep your password secret to prevent any unwanted access.

 

Sharing Your Content

You own all of the content and information you post on New Orleans: A Labor of Love, and you can control how it is shared through your privacy and application settings. In addition:

 

1. For content that is covered by intellectual property rights, like photos and videos ("IP content"), you specifically give us the following permission, subject to your privacy and application settings: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with www.nolaboroflove.org and associated New Orleans: A Labor of Love social media properties ("IP License"). This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it.

 

2. When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).

 

3. When you publish content or information using the "everyone" setting, it means that everyone, including people who are not registered users of www.nolaboroflove.org and associated New Orleans: A Labor of Love social media properties will have access to that information and we may not have control over what they do with it.

 

4. We always appreciate your feedback or other suggestions about New Orleans: A Labor of Love, but you understand that we may use them without any obligation to compensate you for them (just as you have no obligation to offer them).

 

 

Deletions/Corrections/Updates

You can delete your account at your user profile page. You can also edit your personal information to ensure that it is correct and up-to-date. You may delete your information from the Site at any time.

 

Child Under 13

New Orleans: A Labor of Love does not offer the Site to, or knowingly collect or solicit information from, anyone under the age of 13. If you are under 13, do not provide us with any information. Any information we receive from people we believe to be under 13 will be purged from our database.

In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us.

 

Children Between the Ages of 13 and 18

We recommend that minors 13 years of age or older ask their parents for permission before sending any information about themselves to anyone over the Internet.

 

 

Links to Other Websites

The Site may contain links to other websites, including nonprofits and other organizations. New Orleans: A Labor of Love is not responsible for the privacy practices or the content of other websites that may be linked to the Site.

 

Agreement

If you choose to use the Site, your use is subject to the current Terms of Use and Privacy Policy (which is incorporated into and subject to the New Orleans: A Labor of Love Terms of Use) and you consent to our limited use of information as outlined in our Privacy Policy. We reserve the right to change this Privacy Policy from time to time. If we do make changes, we will post any changes on the Site and will indicate the date the changes were made at the top of our Privacy Policy. Non-material changes are effective upon posting. Material changes are effective 15 days after posting. Unless stated otherwise, our current Privacy Policy applies to all information in our possession.

Our goal is to deliver ads that are not only valuable to advertisers, but also valuable to you. In order to do that, you agree to the following:

Special Provisions Applicable to Share Links

If you include our Share Link button on your website, the following additional terms apply to you:

New Orleans: A Labor of Love users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:

 

1. You will not provide any false personal information on www.nolaboroflove.org and associated New Orleans: A Labor of Love social media properties, or create an account for anyone other than yourself without permission.

 

2. You will not use your personal profile for your own commercial gain (such as selling your status update to an advertiser).

4. You will not use www.nolaboroflove.org and associated New Orleans: A Labor of Love social media properties if you are a convicted sex offender.

Trademark: We reserve the right to reclaim user names on behalf of businesses or individuals that hold legal claim or trademark on those user names. Accounts using business names and/or logos to mislead others will be permanently suspended.

Privacy: You may not publish or post other people's private and confidential information, such as credit card numbers, street address or Social Security/National Identity numbers, without their express authorization and permission.

Violence and Threats: You may not publish or post direct, specific threats of violence against others.

Copyright: We will respond to clear and complete notices of alleged copyright infringement. Our copyright procedures are set forth in the Terms of Use.

Unlawful Use: You may not use our service for any unlawful purposes or for promotion of illegal activities.  International users agree to comply with all local laws regarding online conduct and acceptable content.

Verified accounts: You may not use the Verified Account badge unless it is provided by New Orleans: A Labor of Love. Accounts using the badge as part of profile pictures, background images, or in any way implying false verification will be permanently suspended.

 

Spam and Abuse

New Orleans: A Labor of Love strives to protect its users from spam and abuse.  Technical abuse and user abuse is not tolerated on New Orleans: A Labor of Love.com, and will result in permanent suspension. Any accounts engaging in the activities specified below are subject to permanent suspension.

Serial Accounts: You may not create serial accounts for disruptive or abusive purposes.  Mass account creation will result in suspension of all accounts.

Name Squatting: You may not engage in name squatting. Accounts that are inactive for more than 6 months may also be removed without further notice. Some of the factors that we take into account when determining what conduct is considered to be name squatting are:

• the number of accounts created

• creating accounts for the purpose of preventing others from using those account names

• creating accounts for the purpose of selling those accounts

• using feeds of third-party content to update and maintain accounts under the names of those third parties

Invitation spam: You may not use New Orleans: A Labor of Love.com's address book contact import to send repeat, mass invitations

Selling user names: Unless you have been specifically permitted to do so in a separate agreement with New Orleans: A Labor of Love, you agree that you will not reproduce, duplicate, copy, sell, trade or resell the Services for any purpose.

Where "Services" is defined as follows: Your use of New Orleans: A Labor of Love’s products, services and web sites (referred to collectively as the “Services” in this document and excluding any services provided to you by New Orleans: A Labor of Love under a separate written agreement) is subject to the terms of a legal agreement between you and New Orleans: A Labor of Love.

Malware/Phishing: You may not publish or link to malicious content intended to damage or disrupt another user’s browser or computer or to compromise a user’s privacy.

Spam: You may not use the New Orleans: A Labor of Love service for the purpose of spamming anyone. What constitutes “spamming” will evolve as we respond to new tricks and tactics by spammers. Some of the factors that we take into account when determining what conduct is considered to be spamming are:

• If you have followed a large amount of users in a short amount of time;

• If you have followed and unfollowed people in a short time period, particularly by automated means (aggressive follower churn);

• If you repeatedly follow and unfollow people, whether to build followers or to garner more attention for your profile;

• If you have a small number of followers compared to the amount of people you are following;

• If your updates consist mainly of links, and not personal updates;

• If a large number of people are blocking you;

The number of spam complaints that have been filed against you;

• If you post duplicate content over multiple accounts or multiple duplicate updates on one account

• If you post multiple unrelated updates to a topic using #

• If you post multiple unrelated updates to a trending or popular topic

• If you send large numbers of duplicate @replies

• If you send large numbers of unsolicited @replies in an attempt to spam a service or link

• If you repost other user’s content without attribution.

• If you have attempted to "sell" followers, particularly through tactics considered aggressive following or follower churn.

Your account may be suspended for Terms of Use violations if any of the above is true; accounts created to replace suspended accounts will be permanently suspended.

Pornography: You may not use obscene or pornographic images in either your profile picture or user background.

 

Accounts engaging in any of these behaviors may be investigated for abuse.  Accounts under investigation may be removed from Search for quality.  New Orleans: A Labor of Love reserves the right to immediately terminate your account without further notice in the event that, in its judgment, you violate these Rules or the Terms of Use.

 

Special Provisions Applicable to Users Outside the United States

 

We strive to create a global community with consistent standards for everyone, but we also strive to respect local laws. The following provisions apply to users outside the United States:

 

1. You consent to having your personal data transferred to and processed in the United States.

 

2. If you are located in a country embargoed by the United States, or are on the U.S. Treasury Department's list of Specially Designated Nationals you will not engage in commercial activities on www.nolaboroflove.org and associated New Orleans: A Labor of Love social media properties (such as advertising or payments) or operate a developer platform or website.

 

Security

New Orleans: A Labor of Love takes reasonable precautions to protect our users' information. Your account information is located on a secured server behind a firewall. Termination

In all such cases, this Statement shall terminate, but all guidelines governing the security of this site shall still apply.

 

Disputes

1. You will resolve any claim, cause of action or dispute ("claim") you have with us arising out of or relating to this Statement or New Orleans: A Labor of Love exclusively in a state or federal court located in  Los Angeles, North Carolina. The laws of the State of California will govern this Statement, as well as any claim that might arise between you and us, without regard to conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Los Angeles County, California for the purpose of litigating all such claims.

 

2. If anyone brings a claim against us related to your actions, content or information on New Orleans: A Labor of Love, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.

 

3. WE TRY TO KEEP WWW.NOLABOROFLOVE.ORG UP, BUG-FREE, AND SAFE, BUT YOU USE IT AT YOUR OWN RISK. WE ARE PROVIDING NEW ORLEANS: A LABOR OF LOVE "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT WWW.NOLABOROFLOVE.ORG WILL BE SAFE OR SECURE. NEW ORLEANS: A LABOR OF LOVE IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES. IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE §1542, WHICH SAYS: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR." OUR AGGREGATE LIABILITY ARISING OUT OF THIS STATEMENT OR WWW.NOLABOROFLOVE.ORG WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
